The <a href=\"https:\/\/sports7.us\/u-s-women-stage-fair-pay-protest-before-latest-win\/\">USWNT<\/a> got mauled in court on Friday when a federal judge threw out the most important portions of their discrimination lawsuit.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A nearly complete victory for the U.S. Soccer Federation<\/h2>\n\n\n\n<figure class=\"wp-block-embed-twitter wp-block-embed is-type-rich is-provider-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">We will never stop fighting for EQUALITY.<\/p>&mdash; Megan Rapinoe (@mPinoe) <a href=\"https:\/\/twitter.com\/mPinoe\/status\/1256373201283809281?ref_src=twsrc%5Etfw\">May 2, 2020<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>The lawsuit brought by the United States Women\u2019s National Team on behalf of stars like <a href=\"https:\/\/sports7.us\/who-is-megan-rapinoe\/\">Megan Rapinoe<\/a>, <a href=\"https:\/\/sports7.us\/are-the-jets-actually-considering-signing-carli-lloyd\/\">Carli Lloyd<\/a>, and Crystal Dunn, will proceed next month. However, what remains of it is relatively insignificant after U.S. District Judge Gary Klausner eviscerated their case Friday in Los Angeles.<\/p>\n\n\n\n<p>The USWNT was pursuing a discrimination lawsuit against the U.S. Soccer Federation and seeking more than $66 million, contending the players on the international powerhouse deserved pay equal to what the USSF was paying its men\u2019s team.<\/p>\n\n\n\n<p><a href=\"http:\/\/\ufeffhttps:\/\/www.npr.org\/2020\/05\/02\/849492863\/federal-judge-dismisses-u-s-womens-soccer-team-s-equal-pay-claim\">Klausner\u2019s ruling<\/a> called into question the numbers that lawyers for the USWNT provided and then said that question was moot anyway because the union representing the women voluntarily entered into a collective bargaining agreement that offered better base pay but less opportunity to collect bonuses.<\/p>\n\n\n\n<p>&#8220;Plaintiffs cannot now\nretroactively deem their CBA worse than the MNT CBA by reference to what\nthey would have made had they been paid under the MNT's\npay-to-play structure when they themselves rejected such a structure,&#8221; he\nwrote.<\/p>\n\n\n\n<p>The\nonly portion of the lawsuit left intact concerns an apparent double standard by\nthe USSF when it comes to airline travel, hotel rooms, and access to support\nstaff.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The U.S. Soccer Federation went on the attack vs. the USWNT <\/h2>\n\n\n\n<figure class=\"wp-block-embed-twitter wp-block-embed is-type-rich is-provider-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">If you know this team at all you know we have a lot of fight left in us. The U.S. Soccer Federation\u2019s original lawyers\nwere blunt in original court filings that called USWNT players physically\ninferior to their male counterparts and said then men deserved more because\nthey face tougher competition in more lucrative events.<\/p>\n\n\n\n<p>The\njudge ended up disputing the pay argument, but not in a manner favorable to the\nwomen. He calculated that the USWNT\u2019s roster averaged $221,000 in pay per game\nfrom 2015-19 while the men\u2019s average was just $213,000.<\/p>\n\n\n\n<p>He said in his 32-page ruling that the USWNT\u2019s\ngreater success on the field \u2013 four World Cup victories to none for the men \u2013\nwas irrelevant because compensation was spelled out in the teams\u2019 respective collective\nbargaining agreements. For him to strike down a legally negotiated CBA could\nset a dangerous precedent in other labor disputes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What\u2019s next for the USWNT?<\/h2>\n\n\n\n<figure class=\"wp-block-embed-twitter wp-block-embed is-type-rich is-provider-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">We will continue to fight like hell and get what we deserve. <a href=\"https:\/\/t.co\/fwfOMaBfp7\">https:\/\/t.co\/fwfOMaBfp7<\/a><\/p>&mdash; Ali Krieger (@alikrieger) <a href=\"https:\/\/twitter.com\/alikrieger\/status\/1256382566027927553?ref_src=twsrc%5Etfw\">May 2, 2020<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>The\nUSWNT can take U.S. District Judge Gary Klausner\u2019s decision to the U.S. Court of\nAppeals. But winning there would be like overcoming a two-goal deficit while\nplayed shorthanded in the final 10 minutes.<\/p>\n\n\n\n<p>The\nmore productive route for their lawyers might be to continue pressing what\nremains of the lawsuit since the numbers regarding how much is spent on air\ntransportation and hotels are lopsided in favor of the men\u2019s team.<\/p>\n\n\n\n<p>With a small win there likely, the USWNT should reopen the lines of communication with interim USSF president <a href=\"https:\/\/sports7.us\/can-a-former-star-player-fix-u-s-soccers-big-problem\/\">Cindy Parlow Cone<\/a>, who played 158 games for the U.S. women from 1995-2006. <\/p>\n\n\n\n<p>Parlow must certainly understand\nthe value of getting this dispute out of the public spotlight and might be\namenable to putting a deal on the table far less costly than the $66 million\noriginally at stake but enough for the USWNT to walk away feeling as though the\nfight wasn\u2019t a complete shellacking on the level of the U.S.-Thailand game last\nyear.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The U.S. Women's National Team lost big in court in its lawsuit against the United States Soccer Federation.<\/p>\n","protected":false},"author":140,"featured_media":1160406,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[4898],"tags":[10977,8633],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v22.3 (Yoast SEO v22.9) -
